Bad Bunny Wins Dismissal of Sample-Clearance Lawsuit
"As we stated when the case was filed, my client bought the rights to use the music at issue and was never provided evidence of the plaintiffs' contrary claims of ownership. When plaintiffs were forced to provide evidence in the lawsuit, they chose instead to abandon the case, resulting in the dismissal and final judgment in favor of defendants."
Dera accused Bad Bunny of improperly sampling his 2019 track "Empty My Pocket" in the song "Enséñame a Bailar" from the album Un Verano Sin Ti. Dera and his record label emPawa Africa filed a lawsuit in spring 2023, but their legal representatives withdrew due to irreparable differences in January. The case stalled after the lawyers departed, and emPawa was dropped from the lawsuit. Dera failed to file required papers or appear in court by the March 6 deadline. Bad Bunny's legal team maintains the sample was properly cleared and licensed.
