The Supreme Court keeps abortion pill mifepristone available by telehealth

The Supreme Court kept existing abortion access rules in place, allowing mifepristone to remain available through telehealth. The order stayed a May 1 ruling from the U.S. Court of Appeals for the 5th Circuit that would have prohibited mailing mifepristone nationwide. The stayed ruling would have reinstated pre-pandemic requirements requiring patients to receive mifepristone in person at a doctor’s office or clinic. The FDA had determined in 2021 that in-person dispensing was medically unnecessary. Louisiana sued the FDA last fall, arguing that telemedicine access undermines the state’s abortion ban. The decision included public dissents from Justices Samuel Alito and Clarence Thomas.
