The U.S. DOJ has filed a legal complaint against three Medicare Advantage insurers, Aetna, Elevance Health, and Humana, and three broker organizations, alleging illegal kickbacks paid to brokers for increasing enrollments from 2016 to 2021. These kickbacks may have led brokers to push less suitable plans to seniors in favor of those offering the highest financial incentives. The complaint also suggests discriminatory practices towards beneficiaries with disabilities, raising concerns about the integrity of Medicare programs.
Deputy Assistant Attorney General Michael Granston emphasized the DOJâs commitment, stating, "Health care companies that attempt to profit from kickbacks will be held accountable..." We are committed to rooting out illegal practices."
The DOJ's allegations detail that brokers incentivized employees to sell plans offering the most kickbacks, not necessarily those suited for seniors' needs. This manipulation undermines the integrity of the program.
