Aetna, Humana sued by feds over alleged Medicare kickback scheme

The Justice Department has filed a lawsuit against major health insurers CVS Health's Aetna, Elevance Health, and Humana, accusing them of engaging in a kickback scheme from 2016 to 2021. These insurers allegedly collaborated with brokers such as eHealth, GoHealth, and SelectQuote to divert Medicare beneficiaries towards their plans in exchange for substantial kickbacks. The DOJ highlighted that these actions compromise the integrity of the Medicare Advantage program, as brokers, rather than acting in the patients' best interests, directed beneficiaries towards insurers that provided the highest payments.
In a lawsuit filed in Boston federal court, the DOJ alleged that CVS Health's Aetna, Elevance Health and Humana engaged in a vast kickback scheme with insurance brokers from 2016 to 2021.
The Justice Department said that rather than acting in an unbiased manner and in the best interests of patients, the brokers directed Medicare beneficiaries to plans offered by insurers that paid them the most in kickbacks.
