"U.S. District Judge Dale Ho agreed. In mid-February, he dismissed the lawsuit because Manz "failed to state a claim that Los Tacos negligently served excessively spicy salsa." Ho also acknowledged that Manz could have easily discovered that the tacos were spicy with a simple Google search."
"A German tourist faced disappointment after disappointment on his trip to New York in 2024. So much so that he filed three lawsuits seeking $20 million in compensation from a taco chain, Walmart, and the New York Police Department for discrimination and distress. However, all his attempts to get damages were thwarted after judges dismissed the lawsuits."
Faycal Manz, a German tourist visiting New York in 2024 to attend the U.S. Open, filed three separate lawsuits without legal representation seeking $20 million in total damages. His first lawsuit against Los Tacos No. 1 claimed $100,000 for serving excessively spicy salsa that caused mouth and tongue burns, increased heart rate, and blisters. Judge Dale Ho dismissed this case, ruling that Manz failed to prove negligence and could have easily researched the restaurant's spice levels online. The tourist also filed lawsuits against Walmart and the New York Police Department alleging discrimination and distress. All three lawsuits were ultimately dismissed by judges, resulting in complete failure of his compensation attempts.
