A prospective tenant with a Pakistani name applied for apartment viewings and was repeatedly rejected while identical applications under German-sounding names were accepted. The claimant submitted comparable test applications and was offered viewings only when using German surnames. A regional court awarded €3,000 plus legal fees for violation of the General Equal Treatment Act. The Federal Court of Justice upheld that ruling, calling the conduct discriminatory and confirming that real estate agents must follow anti-discrimination law. The higher court also found that creating comparable test applications was lawful and not abusive litigation.
