
Tensions in France have risen over responses to increasing antisemitism. A government-backed bill intended to address the problem was denounced as an attack on freedom of expression and was later shelved. The 2024 draft legislation, introduced by Caroline Yadan, aimed to counter new forms of antisemitism after incidents rose following the 7 October 2023 Hamas massacres. While the explanatory memorandum cited legitimate concerns, the wording shifted toward limiting criticism of Israel. The draft sought to expand offences related to glorifying terrorism to cover indirect incitement and to create a new offence for inciting the destruction or denial of a state. Critics warned that such indirect offences would require courts to infer intent, creating arbitrariness and making it difficult to prove implicit suggestions.
"Freedom of expression in France allows individuals to voice any form of sentiment towards any country as long as there is no incitement to violence. But the purpose of Yadan's bill seemed clear. It proposed widening the existing offence of glorifying terrorism so that indirect incitement could be punished. The draft introduced a new offence penalising the act of inciting the destruction or denial of a state."
