She said that just as making him go into prison even for a bit seemed to follow the existing case law, so would his possible release today. Human rights activists seem to agree with that take, saying he may no longer meet the conditions for pre-trial detention."

Nicolas Sarkozy faces a court decision on whether he will be released from jail pending his appeal against a five-year sentence for criminal conspiracy to obtain campaign funds from Muammar Gaddafi's Libyan regime. Sarkozy has been incarcerated since 21 October; his lawyers requested release with alternatives including electronic ankle monitoring or house arrest. Former rival Segolene Royal said she would not be shocked by a release, and human rights activists indicated he may no longer meet pre-trial detention conditions. His wife, Carla Bruni, and defence lawyer Christophe Ingrain attended the Paris Appeal Court as Sarkozy prepared to appear by video link. A recent visit from justice minister Gerald Darmanin prompted concerns about judicial independence.
