Two new White House directives aim to enhance executive power by allowing the strike down of federal environmental regulations. Legal experts, including Andres Restrepo from the Sierra Club, argue these directives exceed established presidential authority and may not survive legal scrutiny. The April 9 executive order mandates that regulations pertaining to energy production include a sunset provision, effectively making them expire within a year unless renewed. Critics warn such actions could lead to significant chaos in regulatory processes, undermining the foundation of the Administrative Procedure Act.
I do not think this even comes close to passing the test for legality, said Andres Restrepo.
To just arbitrarily have a cutoff date for all regulations...that is simply unlawful.
