A bison rancher, Chris George, erected a gate on Morrison Canyon Road that blocks access to Vargas Plateau Regional Park and is appealing the city's order to remove it. City officials found the gate was illegally constructed and said it obstructs a public right-of-way. The city served a notice in November setting a deadline and warning of at least a $100-per-day fine while the fence remains. The Alameda County Board previously transferred responsibility for the 0.2-mile stretch to the George family, and the rancher installed the gate within two weeks. A hearing is expected soon and the rancher has refused to dismantle the gate. George's attorney appealed the removal order, asserting the order lacked evidence that the roadway is a public street.
