UPDATES - Day 5 of Corpus hearing, former Asst. Sheriff tearfully recalls resignation

Matthew Fox returned to the stand during removal hearings and spoke with hesitation about events surrounding a county report. Fox said he was unaware that deputies' union president Carlos Tapia's code had been changed under Stacey Stevenson and said he would not have opened the Tapia investigation if he had known. Fox led the probe that resulted in Tapia's arrest for alleged time card fraud on Nov. 12, though prosecutors declined to press charges. Fox described conversations with Victor Aenlle about the report's release and choked up when recounting his resignation on Nov. 14.
Fox said he never knew deputies' union president Carlos Tapia's code had been changed by the direction of Stacey Stevenson. If he had known that, he wouldn't have started the investigation, Fox said. Fox led the investigation into Tapia that led to his arrest for alleged time card fraud on Nov. 12, hours before the county released Cordell's report. The district attorney's office declined to press charges against Tapia.
Before the release of the report, Aenlle would talk to Fox about his concern about the Cordell report being released. Fox started choking up, holding back tears, when he was asked why he resigned from the sheriff's office on Nov. 14. Fox said that he started having thoughts of leaving earlier that day, when he was driving over the San Mateo Bridge to pick up his children.
