Alameda County prosecutors secured a rare first-degree murder plea in the 2021 fatal shooting of former San Jose police officer Kevin Nishita, who was working as a KRON4 security guard. Widow Virgina Nishita pursued justice for more than four years. District Attorney Ursula Jones Dickson described a first-degree murder admission as extraordinary. Prosecutors relied on circumstantial evidence including a vehicle with improper license plates, masked suspects, and no eyewitness identifications. Oakland police executed more than 120 warrants and the U.S. Marshals assisted. Cellphone evidence played a key role. Plea deals reduced the total charges against the defendants.
"I know he is proud of me and his family,"
"I was on the bench for 11 years before I was in this position. And I don't remember a first-degree murder that somebody admitted to,"
"These three individuals were driving in a car without the proper license plates. They were masked up. There were no eyewitness identifications on the scene,"
"So what we mean by a circumstantial evidence was that the case was built not on direct eyewitness testimony, but more on the hard work investigation."
