"The 9th U.S. Circuit Court of Appeals ruled in September that Green's excessive-force lawsuit could proceed to trial, but now the San Jose City Council could approve an $8 million settlement at its Jan. 13 meeting. This is a negotiated settlement between the parties to avoid the risks inherent in litigation, City Attorney Susana Alcala Wood wrote in a memo to the City Council recommending the settlement."
