"Many of the people being detained and deported are parents with children. So what happens to the kids when their parents are deported? A recent CNN article notes that many have ended up in the care of relatives, neighbors, friends, coworkers and even strangers after ICE detained or deported their parents, and adds that quite a few just end up shoved into the foster care system."
California enacted AB 495, the Family Preparedness Plan Act of 2025, allowing immigrant parents to designate a caregiver to assume responsibility for children if parents are detained or deported. The law forbids childcare facilities and state preschools from collecting immigration status information. The law protects parental legal rights, secures children's continuity of care, and requires schools to develop safety plans for crises. Nearly one million U.S. citizen children in California face risk of separation due to immigration enforcement. Many children currently end up with relatives, neighbors, friends, coworkers, strangers, or placed into the foster care system. The law aims to keep families' private information confidential and reduce unnecessary family separation.
