"Quo warranto is used to test a person's legal right to hold an office, not to evaluate the person's performance in the office,"
"For example, a quo warranto action may be brought to determine whether a public official satisfies a requirement that he or she resides in the district; or whether a public official is serving in two incompatible offices."
A city councilmember moved to agendize initiating a Quo Warranto process to address questions about mayoral residency. The Solano County District Attorney has been looking into whether the mayor lives inside city limits. The mayor maintains that she lives in Fairfield with family and describes the concerns as a political attack by California Forever. The councilmember emphasized the legal residency requirement for holding city office and the need to preserve public trust. Quo Warranto (Cal. Code Civ. Proc. §§ 803–811) tests a person’s legal right to hold office and can determine residency eligibility. The city council would prepare a complaint to pursue the process.
