"Some bad decisions nearly three years ago resulted in one person losing his life, another person losing his freedom and many friends and family members left with eternal loss and sadness. The Suffolk County District Attorney characterized the incident as stemming from poor choices that devastated multiple lives and left lasting emotional impact on the victim's loved ones."
"Videos further show Sadiq as he looked around, and then raised his right arm and struck Whelan in the head area when Whelan was turned facing the ATM. Whelan then fell back, hitting his head on the ground as Sadiq walked away. This sequence of events, captured on surveillance footage, demonstrated the violent nature of the assault that ultimately proved fatal."
"The conversation was purportedly racial in nature after Whelan - allegedly drunk at the time - called Sadiq the N-word. The pair did not know each other. This detail established that the fatal confrontation arose from a chance encounter between strangers that escalated due to racial language and resulted in tragic consequences."
Sanusi Sadiq, 31, received a sentence of three to six years in state prison for the manslaughter conviction of Barry Whelan, 46. Whelan was found unresponsive outside an ATM on Winter Street in Downtown Crossing on March 17, 2023, with a head abrasion. He was transported to Tufts Medical Center with a traumatic brain injury and died three days later on March 20. The Chief Medical Examiner ruled his death a homicide caused by blunt force trauma. Surveillance video documented a heated argument between the two strangers that turned racial in nature after Whelan allegedly used a racial slur. Video evidence showed Sadiq striking Whelan in the head while Whelan faced the ATM, causing him to fall and hit the ground.
