The Rhode Island District Attorney's office dropped charges against John Vieira and Justin Mitchell related to the death of Dale Mooney during a brawl at Gillette Stadium in September 2023. Both men faced charges of assault and battery, but the DA determined it was 'in the interest of justice' not to proceed following a thorough investigation. Evidence suggested that Mooney had attacked Mitchell first, prompting Vieira to intervene, thus leading to the altercation that resulted in Mooney's death. A complete review led to the conclusion that the men acted in self-defense rather than with intent to harm.
The fight broke out just before 11 p.m. during the game on Sept. 17, 2023 in Section 310 where Mooney, Vieira, and Mitchell were sitting.
Prosecutors said the charges against the two men were dropped 'in the interest of justice,' following a hearing on Friday.
Vieira's attorney, Peter Aspesi, stated he was pleased the DA's office dropped the charges after a careful review of all the evidence.
The DA's office determined that there wasn't a basis for criminal charges related to homicide, despite Mooney's death being ruled a homicide.
