Khalil's legal representative, Marc Van Der Hout, expressed outrage at this admission, emphasizing the dishonesty of DHS officials. Following his arrest, a warrant was issued during his processing at an ICE facility. The government justifies the warrantless arrest by suggesting Khalil's behavior indicated a likelihood of flight, which contradicts video evidence presented by his wife, showing the events differently.

DHS agents who arrested Mahmoud lied to him: They wrote in their arrest report that the agents told him that they had an arrest warrant, but DHS has now admitted in their filing that that was a lie and that there was no warrant at all at the time of the arrest.
