Guests at resort pools often reserve sun loungers by placing towels early in the morning and leaving them unused, despite hotel rules. By late morning, other guests may be left standing in the sun because the beds are unavailable. A German court in Hanover found a tour operator responsible for this situation as a travel defect under German law. The ruling granted a refund to a tourist who said a package holiday failed to provide fair access to loungers. The case involved an 11-night August 2024 stay at Grecotel Kos Imperial on the Greek island of Kos, booked through TUI Deutschland. The hotel posted signs limiting towel reservations to 30 minutes without use, and the court held the operator liable for the breach.
"The case involved a family who booked an 11-night package holiday at the Grecotel Kos Imperial, a premium resort on the Greek island of Kos, in August 2024. The plaintiff paid about $8,500, the court said. The hotel had signs posted at the pools prohibiting guests from reserving sun beds with towels for more than 30 minutes without actually using them, according to a document describing the verdict."
