Bayern lose Luis Diaz's red-card appeal despite ref admission
"The second yellow card is very harsh and when I see the images now, I wouldn't give it that way any more. However, that wasn't enough for the German football association's sports court to overturn the automatic one-game ban for a sending-off."
"The decisive factor is that the incident constitutes a decision of fact which can only be corrected if it is gravely, clearly and without any doubt objectively incorrect. That is not the case here."
Luis Díaz received a second yellow card for diving during Bayern Munich's 1-1 draw with Bayer Leverkusen, resulting in a sending-off and automatic one-game ban. Referee Christian Dingert later acknowledged in a postgame interview that he missed contact between Díaz and goalkeeper Janis Blaswich, stating he would not have issued the card after reviewing replays. Bayern appealed the ban, but the German football association's sports court rejected it. Court chairman Stephan Oberholz ruled that Dingert's comments were irrelevant and that the decision was not "completely wrong" because Díaz had been seeking contact. The court determined the incident constitutes a factual decision that can only be overturned if gravely, clearly, and objectively incorrect. Díaz must serve the ban against Union Berlin on Saturday.
