A California jury unanimously dismissed Elon Musk’s lawsuit against OpenAI and Sam Altman because the claims were filed after the statute of limitations expired. Musk alleged Altman breached a non-profit contract by shifting the ChatGPT-maker toward a for-profit structure after Musk donated $38 million. Musk claimed Altman accepted the donation while deceiving him about maintaining OpenAI’s original non-profit mission to develop AI technology for humanity. The jury heard testimony from Musk, Altman, and Satya Nadella of Microsoft, which Musk accused of participating. Musk’s claims against Microsoft were dismissed as a matter of law based on the jury’s findings on the claims against OpenAI. OpenAI was founded in 2015, and Musk left in 2018 after co-founders denied him control.
