Musk sued OpenAI and Altman in 2024, alleging pursuit of profits over the public good and attempted to block restructuring to a for-profit; a judge denied that request. OpenAI abandoned an outright for-profit conversion and is seeking public benefit corporation status while investor funding remains tied up. Musk later refiled suits, and xAI alleges that OpenAI systematically hires former xAI employees to obtain trade secrets, including Grok's source code.
