According to the lawsuit, Cardello-Smith claims he was offered a spiked drink, which he accepted, leading to him passing out, after which he purportedly awakened to find Combs having sex with a woman and making a statement implying he had also assaulted Cardello-Smith.
Combs’ attorney, Marc Agnifilo, strongly contested the credibility of Cardello-Smith, labeling him a 'convicted felon and sexual predator' with a long history of legal troubles, including 14 counts of sexual assault and kidnapping. Agnifilo argued that Cardello-Smith’s lawsuit was fraudulent, asserting that Combs had no prior knowledge of him or any lawsuit against him, and expressed confidence that the judgment would be overturned quickly.
The legal legitimacy of the lawsuit has been called into question, with reports indicating there may be procedural issues regarding whether Cardello-Smith served Combs appropriately.
