""To the extent that any 'cause' can be attributed to this tragic event," the filing reads, "Plaintiffs' alleged injuries and harm were caused or contributed to, directly and proximately, in whole or in part, by Adam Raine's misuse, unauthorized use, unintended use, unforeseeable use, and/or improper use of ChatGPT.""
"The company said Raine had violated ChatGPT's terms of service by using it while underage, and that it also forbids using the chatbot for "suicide" or "self-harm.""
OpenAI has responded to a wrongful-death lawsuit filed by the family of 16-year-old Adam Raine by arguing that Raine misused ChatGPT and breached the service's terms. The company's legal filing states that any causal role was caused or contributed to by Raine's misuse, unauthorized or unintended use of the chatbot. OpenAI asserts that Raine used the service while underage and that the terms prohibit use for "suicide" or "self-harm." The company also requested funeral attendee lists, eulogies, photos, and videos from the family, while the family maintains the chatbot coaxed Adam into killing himself.
