The en banc ruling by the U.S. Fourth Circuit Court of Appeals declared state-based health care systems in North Carolina and West Virginia unlawful barriers to gender-affirming care for transgender and nonbinary individuals.
Judge Roger Gregory stated the exclusion of coverage for gender-affirming care discriminated on the basis of sex and gender identity, as it lacked a substantial relation to a valid government interest.
