Kivlighan de Montebello, a third-year student at the University of Massachusetts Amherst, received a one-year suspension after organizing a Sept. 29 peaceful protest at the campus center during a career fair targeting RTX (formerly Raytheon). RTX manufactures weapons and military technology used by the Israeli military in Gaza. De Montebello, a member of Students for Justice in Palestine, filed a complaint in Hampshire Superior Court arguing the suspension violates his First Amendment rights because the protest did not disrupt university operations or infringe others’ rights. The Massachusetts chapter of the National Lawyers Guild and law firm Zalkind Duncan & Bernstein LLP represent him. The lawsuit seeks a jury trial, unspecified damages, and expungement of the suspension. UMass stated that expressive activity may face reasonable restrictions to ensure speech and protest do not block access or operations.
