Government attorneys had argued that the pause was justified by new, classified information regarding offshore wind's impacts on national security revealed by the Pentagon in November. Lamberth rejected the administration's argument that national security concerns justified halting the project, which he said would be irreparably harmed without an injunction."

The pause had affected five offshore wind leases and was justified by officials using classified Pentagon information citing national security concerns. Government attorneys argued the new information warranted the suspension, but the judge found the project would suffer irreparable harm without an injunction and questioned stopping work that costs roughly $1.5 million per day. rsted contended the pause violated administrative procedure and due process and prevented review of the classified assessment. Revolution Wind is about 87% complete and expected to begin generating power this year as a 50-50 joint venture between rsted and Global Infrastructure Partners.
