The deployment included members of the DC National Guard and guard units from other states and was alleged to cause irreparable harm to the District. The suit was filed by DC Attorney General Brian Schwalb on behalf of the District. The ruling noted that, although the President is the DC Guard's commander, neither the DC Code nor the Constitution authorized the deployment in these circumstances. Cobb stayed the ruling until December 11 to allow the administration time to appeal.
