Rep. Seth Moulton introduced the National Oversight and Enforcement of Misconduct Act (NOEM) to amend civil rights law to include agents from any federal immigration enforcement authority. The amendment would allow federal litigation against immigration agents in cases alleging Fourth or Fifth Amendment violations. The proposal targets immigration enforcement specifically rather than all federal agents. Moulton states that victims currently have almost no legal recourse and that ICE agents enjoy near-total immunity for rights violations in public, homes, and on the street. Existing Bivens actions are limited and have been further curtailed by the Supreme Court.
