"Federal officials acting in the course of their duties are immune from liability under state law. The Department of Homeland Security stated that such enforcement is a federal responsibility and states cannot prosecute federal officers, arguing that what states are attempting to do is unlawful and that local officials should consider how their actions have endangered federal law enforcement officers."
Hennepin County Attorney Mary Moriarty announced an investigation into 17 cases involving federal officers' misconduct during immigration enforcement operations. The investigation includes Greg Bovino, a border patrol official, for throwing a smoke canister at protesters on January 21. Federal agents are also under investigation for shooting deaths of two U.S. citizens, Renee Good and Alex Pretti, on January 7 and 24. Additional cases involve federal officers making arrests near a high school while deploying chemical irritants near students and staff. The Metro Surge operation prompted nationwide criticism of federal use-of-force policies. The Department of Homeland Security responded that federal officers are immune from state prosecution, arguing immigration enforcement is a federal responsibility.
