Meet the Michigan state senator pushing to enshrine marriage equality protections in the state constitution
""Marriage equality in Michigan only exists because of Obergefell," Moss said. "If a future case should overturn Obergefell, it goes right back into that language that has existed in our Constitution since a public vote in 2004.""
""We know how the Supreme Court operates," Moss said. "Are the conservatives looking for a stronger case? Will a future court decide differently? We cannot let the whims of the current or future court dictate our destiny.""
Jeremy Moss introduced a resolution to place repeal of Michigan’s 2004 constitutional same-sex marriage ban on the 2026 ballot. Moss is also running for Congress in Michigan’s 11th District and aims to become the state’s first out LGBTQ+ member of Congress. Michigan’s 2004 amendment bans same-sex marriage and civil unions, leaving marriage equality dependent on the U.S. Supreme Court’s Obergefell decision. The Supreme Court’s recent refusal to hear Kim Davis’s appeal did not settle the issue, and conservative justices have signaled potential openness to revisiting Obergefell. Moss says Michigan cannot rely solely on uncertain future court decisions to protect rights.
