The Trump administration is also reportedly drafting an executive order that would allow the Department of Justice to sue states over their AI regulations."

The administration is pursuing measures to prevent states from enacting independent AI regulations by promoting a single federal standard and exploring legal mechanisms to challenge state rules. An executive order under consideration could authorize the Department of Justice to sue states that impose their own AI restrictions. Republican efforts earlier attempted a 10-year moratorium on state AI regulation as part of a major bill, but that provision was removed after Senate opposition. The administration's AI Action Plan also proposed withholding federal funds from states with strict AI rules. Some Republicans, including Rep. Marjorie Taylor Greene, argue that states must retain regulatory authority.
