Judge Paula Xinis granted Kilmar Abrego Garcia's request for release from ICE custody after determining the government lacked a final removal order. Abrego Garcia, an El Salvador native and Maryland resident, was mistakenly sent to a prison in El Salvador in spring despite a prior judicial order. The government returned him to the United States and immediately charged him in Tennessee with human smuggling. The judge found that officials attempted unexplained deportations to various African countries even though Abrego Garcia offered to go to Costa Rica. He had been detained since August and faces conditions on release tied to Tennessee criminal charges.
