Bovino was recorded throwing tear gas canisters into a crowd without warnings or dispersal orders. Bovino later claimed he was struck by a rock before deploying gas; video evidence contradicted that claim. Judge Sara Ellis found Bovino's testimony not credible, upgraded the TRO to a preliminary injunction, and criticized federal tactics as threatening protesters' constitutional rights.
