Abortion in Malawi was previously permitted only when a womans life was in danger. Malawis Gender Equality Law affirms the right to adequate sexual and reproductive health and the right to choose whether to have a child, subject to law. Women's rights organizations have lobbied for a Termination of Pregnancy Bill for over 15 years; a draft exists but has not been tabled in parliament. A 14-year-old rape survivor sued after being denied a safe abortion at a public facility. The High Court found forcing a child to carry a pregnancy from violence cruel, inhuman and degrading, and ordered the Health Ministry to amend postabortion care guidelines within 180 days to ensure survivors can access lawful terminations.
