James Fotherby, 43, a Napa County sheriff's deputy, faces one count each of invasion of privacy and distribution of a private image causing emotional distress, both misdemeanors with up to six months jail per count. On Dec. 1 a special allegation based on the victim's domestic partner status was added, calling for at least three years probation. Fotherby pleaded not guilty to both counts and denied the special allegation. He has been on paid administrative leave for two months or more. Napa Police Department and the District Attorney's Office will handle further investigation. An arrest form filed Sept. 26 alleges Fotherby distributed nude images from 2023–2025 and admitted doing so in text messages and a pretext phone call. Fotherby initiated divorce proceedings on Aug. 4, and the victim is not being named.
