"ICE at no point explained to Ms. Rodriguez Gutierrez what was happening. Throughout the arrest, Rodriguez Gutierrez had pleaded with officials to allow her to get medical equipment the 6-year-old needed from another family member who was outside of the ICE office but was denied."
"It's incredibly cruel to rip a child, as they are thriving and not only using the assistive devices that they need ... out of this incredibly brave and strong progress that he has made. Sign language in Colombia is different from the American Sign Language the young student had been learning here."
"ICE violated the family's due process rights by repeatedly misleading immigration attorneys about their whereabouts. De Bremaeker was not able to locate the family until days following their detention."
A 28-year-old mother from Hayward, Lesly Rodriguez Gutierrez, reported to an ICE office in San Francisco for what she thought was a routine check-in to renew photos of her two children, ages 4 and 6. Her 6-year-old son attends the California School for the Deaf in Fremont and has severe disabilities requiring medical equipment and assistive devices. During the visit, ICE arrested the family and deported them to Colombia without proper explanation. Advocates and officials claim ICE violated the family's due process rights by not explaining what was happening, denying access to necessary medical equipment, and misleading immigration attorneys about their whereabouts. The deportation separated the child from his educational progress and the sign language instruction he was receiving.
