"Brian Walshe returns to court Friday as doctors assess whether he is mentally competent to stand trial for allegedly killing his wife, Ana, on New Year's Day in 2023. Walshe will appear in Norfolk Superior Court after a scheduled Oct. 27 hearing was canceled. The case stalled when an inmate reportedly stabbed Walshe in jail on Sept. 11."
"Despite Walshe showing progress since the attack, his lawyer, Larry Tipton, previously wrote in court documents that the "mental and physical effects of the violent assault" continued to prevent Walshe from fully participating in preparing his defense, adding that he was not functioning at the same level as before the incident. Judge Diane Freniere, at a conference review on Oct. 31, set his competency hearing for Friday, saying she hoped to wrap up the case by Christmas."
Brian Walshe will appear in Norfolk Superior Court for a competency hearing Friday as doctors evaluate whether he can stand trial for allegedly killing his wife, Ana, on New Year's Day 2023. A scheduled Oct. 27 hearing was canceled after an inmate reportedly stabbed Walshe in jail on Sept. 11, and his lawyer says the assault's mental and physical effects have hindered his ability to prepare a defense. Walshe is charged with murder, intimidating a witness, and dismembering and discarding his wife's body. Judge Diane Freniere set the competency hearing and expressed hope of resolving the case by Christmas. Court dockets list a final pre-conference on Nov. 17 with jury selection beginning Nov. 18.
