2024 PAGA Reforms - Has the Landscape Changed?

The Private Attorneys General Act (PAGA), enacted in 2004, upturned California's employment law landscape, allowing employees to file lawsuits for civil penalties on behalf of others.
In reality, PAGA created great opportunities for frivolous employment claims benefiting plaintiff attorneys far more than the employees that the law was designed to protect.
The new law includes increased pre-filing requirements and judicial authority to determine manageability of claims in order to reduce frivolous PAGA lawsuits.
The overall number of filings in July and August 2024 shows a slight decrease compared to the same time in 2023, indicating potential effectiveness of the reforms.
